Section 1 - Payment, Expenses and Charges

1a. The total cost of the Vintage Camera Experience will be £60.00 for the hire of 1 analogue camera/s and purchase of 1 roll/s of film. Full payment will be required prior to delivery of the workshop.

1b. Additional films may be purchased during the workshop depending on availability – prices dependant on filmstock available. Payment of additional films is required upon immediate purchase.

1c. On the request of the participant, prints, canvas and various other items can be purchased. The photographer shall provide an item list with prices upon request.

1d. The participants may cancel up to 48 hours prior to the workshop's start time and receive a full refund. However, any cancellations made within 48 hours of the workshop start time will result in the forfeiture of any payments made.

1e. Should the participant wish to cancel the experience less than 48 hours prior to the booking, if the participant does not show for the booking or does not attend the meeting point at the designated start time, a refund cannot be issued.

 

Section 2 - Force Majeure

2a. The fulfilment of this contract is subject to alteration or cancellation by either party due to unforeseen circumstances beyond their control. While all equipment undergoes regular checks and necessary precautions are taken to ensure backup equipment availability, the photographer shall not be held responsible for any photographs that are not produced as a result of technical malfunctions.

2b. Given the nature of the vintage cameras and the intricacies of film involved, any resulting images shall be deemed satisfactory. Participants, acting as photographers utilising the vintage cameras and granted the opportunity to develop the films used, acknowledge that the photographer bears no responsibility for any inability to produce images.

2c. If the participant encounters challenges in producing images, it is important to note that no specific number of images are guaranteed due to the nature of the workshop. The photographer reserves the right to consider providing additional time, film and equipment at their discretion, dependent upon availability and the circumstances at hand.

2d. In the event that the weather conditions are unsuitable, the Vintage Camera Workshop may be cancelled at short notice. Each participant will be informed, and an alternative workshop date (within 6 months) will be proposed. If the rescheduled date is unsuitable, the participant will be entitled to a full refund.

 

Section 3 - Display

3a. By participating in this workshop, the participant grants the photographer permission to display any photographs captured during the event for promotional purposes such as but not limited to, advertising, websites, social media, sample albums etc, although copyright of all images taken by the participant will remain with the participant.

 

Section 4 - Copyright

4a. Under the Copyright Designs and Patents Acts, Chris G Smith Photography holds the copyright of the images the photographer captures. Any images or reproductions, whether stored digitally or otherwise, including computer programs, files, source or object code, or printed documentation related to these images are protected by the Copyright and Design Act 1998. It is a violation to the Act to copy or allow to be copied photographically, electronically or by any other means an image created as part of this contract without the prior written permission of the photographer.

4b. In the event that the photographer captures images during the workshop, they will be digitally transferred to the relevant participant via WeTransfer.

4c. The photographer grants the participant permission the use of any photographs provided to them for personal use (e.g. social media) and printing purposes.

4d. The Copyright Designs and Patents Acts dictates that the participant retains copyright ownership of the images they capture. Consequently, the participant will receive the digital scans and negatives (with digital scans to be sent via WeTransfer.com).

4e. The participant grants the photographer permission for the use of any of digital scans for promotional purposes such as but not limited to, advertising, websites, social media, sample albums etc., although copyright of all images taken by the participant will remain with the participant and they will be credited as such.

 

Section 5 - Limitation of Liability

5a. In the rare occurrence of photographic failure, contract cancellation by either party, or any other circumstance, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

5b. If a participant causes damage to the photographer’s equipment, they will be held liable for any associated costs incurred, including but not limited to insurance excesses.

5c. In the event of damage caused by a participant to public areas, furniture, fences or any other property beyond the control of the photographer, the participant shall bear sole responsibility for any resulting consequences. Chris G Smith Photography takes great pride in preserving the areas they work in.

 

Section 6 - Personal Accident

6a. At the commencement of the workshop, participants will receive a health and safety briefing. Subsequently, it is the participants responsibility to adhere to safety guidelines and assume accountability for their own safety. The photographer cannot be held liable for any personal accidents that may occur during the photographic workshop.

6b. If participants willingly put themselves in dangerous situations the photographer retains the authority to terminate the workshop immediately in the interest of their safety. No refund will be available in this event. The participant will also not be invited to attend future workshops.

Section 7 - Governing Law

8a. This agreement shall be governed in accordance with the laws of Scotland.
